Terran Gold — Terms of Service

1 · Acceptance

By downloading, installing, or using the Terran Gold mobile application ("Service", "App"), you ("You", "Player") enter into a binding agreement with Sicarii Business LLC ("Company", "we", "us"). If you don't agree, stop using the App and delete it. If you continue using the App after we post an updated version of these Terms in-app or at sicariibusiness.github.io/terran-gold-legal/terms.html, you accept the update.

2 · Eligibility

• You must be at least 18 years old (or 21+ in Alabama and Nebraska, or the local age of majority, whichever is higher).
• You must not reside in any region where our Service — including cash rewards — is prohibited. See §11 (Regional Availability).
• You must not be on any government sanctions list (OFAC, HMT, EU consolidated list, etc.).
• You must have the legal capacity to accept these Terms in your jurisdiction.

3 · Skill-Based Gameplay (Not Gambling)

Terran Gold is a skill-based location game. Players earn gold through active tile selection, strategic property upgrades, timed mini-games, and referral effort — not by staking money on random outcomes. Random elements (Prospector's Chest, Daily Chest, expedition loot) are supplementary in-game rewards, not the primary progression mechanic. Purchase-based upgrades accelerate progress but do not determine cash outcomes. Loss-of-stake mechanics (i.e., losing money you paid) are not present anywhere in the Service.

Where local law defines gambling as "any staking of money on a chance outcome for a prize", Terran Gold does not fit that definition because no purchase is required to earn cashouts (see §7) and outcomes are primarily determined by player action, not chance.

4 · Accounts

• One account per person. Multi-accounting to double-collect referral / cashout rewards is grounds for permanent suspension and forfeiture of pending payouts.
• Sign-in is via Google account (Emergent-managed). You are responsible for keeping your Google account secure.
• We may suspend or terminate accounts we reasonably believe are engaged in fraud, chargeback abuse, botting, geo-spoofing (VPN into a supported region from a restricted one), or violation of these Terms.
• You can delete your account at any time from Profile → Account → Delete Account. Deletion is irreversible after a 30-day grace period.

5 · In-App Currencies

Gold

Gold is earned through mining, achievements, quests, streaks, expeditions, and property income. Gold can be spent on properties/upgrades OR — subject to §7 — converted to USD and cashed out via PayPal at a rate of 1,000,000 gold = $1.00 USD.

Terran Credits ("TC")

TC is a paid in-game currency purchased through the app's Store or earned through quests, achievements, streaks, expeditions, and the Battle Pass. TC is spent on properties, expedition tickets, and reroll boosts. TC cannot be converted back to real currency, USD, or gold. TC has no monetary value outside the App.

6 · Purchases (IAP)

• All in-app purchases are processed by Google Play, Apple App Store, or (for web) RevenueCat / Stripe. We do not store your payment credentials.
• Purchases are non-refundable once the digital goods are delivered, except where required by law (Google Play policy for accidental purchases, EU 14-day withdrawal for digital content once you explicitly consent to instant delivery, Apple's standard refund policy).
• Prices are shown in your local currency at checkout. Applicable taxes (VAT/GST/sales tax) are collected by the store and remitted per local law.
• Subscription auto-renewals can be managed from your device's app-store settings.
• The "Founder's Fortune" starter pack is a one-time cosmetic-and-gold bundle limited to the first 100 purchasers globally. Bundle contents (gold, tiles, boost time, badge) are non-cashable except via the normal gold-to-USD path.

7 · Cash Rewards (PayPal Cashouts)

• No purchase required. A player can reach the minimum $1.00 cashout entirely through free gameplay (mining, quests, ads).
• Cashouts pay to the PayPal email you provide. You are responsible for the accuracy of that email.
• Payouts are typically processed within 24–48 hours; delays of up to 10 business days may occur during high-volume periods, KYC review, or fraud investigation.
• We may require identity verification (name, DOB, government-issued ID number, tax form) for cumulative payouts exceeding $600 in any calendar year (US: for IRS 1099-MISC), £1,000 (UK: HMRC threshold), or the local equivalent.
• Tax on cashouts is the player's responsibility. In the US, prizes over $600/year trigger IRS Form 1099-MISC reporting. In the UK, prize winnings from skill games are generally tax-free but you must self-report if the activity constitutes a trade. Consult a local tax advisor.
• We reserve the right to reverse or cancel any cashout that is the result of a bug, exploit, botting, multi-accounting, or chargeback abuse.
• Australia: Skill-game prizes are not subject to gambling tax; income-tax rules may apply above thresholds.
• Japan: Cashouts are treated as temporary income (一時所得); annual amounts above ¥500,000 are taxable — please self-report to the NTA.

8 · Prohibited Conduct

• No cheating, botting, macros, memory editing, packet manipulation, or emulator abuse.
• No VPN / GPS spoofing to appear in a supported region while physically located in a restricted one.
• No purchasing / selling / trading Terran Gold accounts, gold, TC, or cash-out receipts outside the App.
• No abusive behaviour toward staff, moderators, or other players in any public channel.
• No use of the Service for money-laundering, tax evasion, or any other unlawful purpose.
• Violations may result in immediate suspension, permanent ban, and forfeiture of any pending or paid cashouts.

9 · Content, IP, and License

All in-app art, music, code, tile designs, logos, and gameplay mechanics are © 2025–2026 Sicarii Business LLC. You receive a limited, revocable, non-transferable licence to use the Service for personal, non-commercial purposes. You may not reverse-engineer, decompile, or extract assets from the App except to the extent local law prohibits waiving that right (e.g. EU Directive 2009/24/EC Art. 6 interoperability).

10 · Privacy & Data

Data handling is governed by our Privacy Policy, which forms part of these Terms. By using the Service you consent to the processing described there. EU/UK/CH players have the additional rights described in the Privacy Policy §GDPR. Israeli players have rights under the Protection of Privacy Law 5741-1981. Californian players have CCPA/CPRA rights described in the Privacy Policy.

11 · Regional Availability

The App and its cash-rewards feature are available in the following markets as of the effective date:

• 🇳🇿 New Zealand, 🇨🇭 Switzerland, 🇳🇴 Norway (gameplay only; cashouts pending local review)

12 · Disputes & Arbitration

United States

Any dispute arising out of or relating to these Terms shall be resolved by binding individual arbitration under the JAMS Streamlined Arbitration Rules, in Wilmington, Delaware, with the arbitrator selected under JAMS default procedures. Class actions and jury trials are waived to the fullest extent allowed by law. Small-claims court in your county of residence is preserved. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support.terrangold.app@gmail.com with subject "Arbitration Opt-Out".

EU / UK / IL / JP / KR / IN residents

Mandatory local consumer-protection rights are unaffected. EU residents may bring claims in the courts of their country of residence and may use the EU ODR platform (ec.europa.eu/consumers/odr).

Rest of world

Delaware law governs; disputes to be resolved in Delaware state courts.

13 · Warranty & Liability

The Service is provided "as is". To the maximum extent permitted by applicable law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement). Our aggregate liability to you for any claim relating to the Service is limited to the greater of (a) the total amount you paid us in the 12 months before the claim, or (b) US $100.

Nothing in these Terms limits liability for (i) death or personal injury caused by our negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any liability that cannot be excluded under your local consumer-protection law.

14 · Modifications

We may revise these Terms at any time. Material changes (economy, cashouts, regional availability, dispute resolution) will trigger a re-consent prompt in the App. Continued use after the effective date constitutes acceptance.
